- By entering the competition, you confirm that you have read and understood the terms and conditions below and will adhere to them. All participants and winners agree to be bound by these rules, which will be interpreted by Eskom, in its sole discretion and its decision regarding any dispute will be conclusive, final and binding and will not be challenged on any grounds, including without limitation, the grounds that Eskom may be perceived to have failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles of procedural fairness.
- Entering the competition is free of charge.
- A business entering the competition must be a small or medium enterprise.
- Past winners of the competition are not eligible to enter the Business Investment Competition (BIC).
- A business entering the competition must be 100% South African owned and operate within the agricultural/agro processing, manufacturing, construction, engineering, trade/services sector to enter the competition.
- The business entering the competition must be 100% Black owned.
- The competition is not open to a director, employee or agent of, or consultant to Eskom and their immediate families, the prize sponsors or their respective advertising, media and PR agencies who have registered black owned enterprises.
- The business must be legally registered and operational for the last 24 months in any of the 9 provinces, in the Engineering/Construction, Manufacturing, Agriculture/Agri-processing and/or Trade / Services sectors.
- Entrants agree to providing truthful information about their business and to not plagiarize. Should it be discovered that an entrant has submitted content / business documents / ideas that are not theirs, they will be disqualified from the competition.
- Applicants are required to submit an online application, which is followed by two rounds of adjudication to select the winners and runners-up.
- Entrants will be notified via email if they have made it through the first round of adjudication.
- Entrants who make it through the first round of adjudication will be invited to present to an adjudication panel.
- Entrants who are short listed after the first round of adjudication agree to attend the 2nd adjudication session online or virtually. The schedule and more details will be advised.
- Entrants consisting of one representative of the company agree to prepare at their costs a presentation about their business, in English and present same to a panel of adjudicators. The schedule and more details will be advised.
- Entrants’ presentations must include examples of their products (for adjudication purposes), services and marketing materials (posters, banners, pamphlets, business cards, etc).
- If a short-listed entrant is not able to present to the adjudication panel, their entry will be disqualified and will not be replaced.
- After the adjudication session all entrants will receive communication indicating whether they have qualified as finalists or not.
- For those notified as finalists, the entrant agrees that an Eskom Representative may visit the business with a photographer. Business owners may agree to have photographs taken of their premises, production facilities, staff and owners for publicity purposes.
- Finalists also agree to attend the BIC Awards ceremony through a webinar. The schedule and more details will be advised. You can invite up to 5 representatives from each business to attend the event.
- The overall winner and the four sector winners will be giving acceptance speeches at the Business Investment Awards evening in English.
- The allocated prize monies of R300 000 for the overall winner, R131 250 for each sector winner, R75 000 for each sector 1st runner up, and R50 000 for each sector 2nd runner up are final. Income taxes relating to the prizes, if any, are the sole responsibility of the prize winners.
- Finalists are solely responsible for providing accurate banking details, with proof of account for Eskom to pay the prize money. Motivation from the company on how the business intends to use the prize money, BEE certificate, tax clearance certificate and ID documents of company directors are also required for Eskom to release the prize money.
- Finalists acknowledge that the prize money payment will not be immediate as Eskom has internal legal and financial processes to follow before payments are made.
- Finalists have the choice to participate in a two-day business training and coaching session “Business Connect”, to be held virtually. The schedule and more details will be advised.
- All finalists have the option to do interviews with the media and to have their photographs taken.
- All finalists have the option to allow media site visits of their business premises, which will be organised by the Eskom PR agency. The business owner will be notified and briefed ahead of the time.
- The Entrants’ personal information, with their consent, will be available exclusively for Eskom, and its subsidiaries’ marketing purposes and, by participating in the competition, the entrant expressly consents to the transfer, storage and processing of the information in South Africa. Eskom keeps the information to fulfil the purposes for which it was collected or as required by applicable laws or regulation.
- Eskom does not seek to claim ownership of the entrant’s submission to the competition; but by submitting an entry, the entrant has the option to grant Eskom as well as its subsidiaries the non-exclusive, perpetual, irrevocable, royalty-free, unconditional, fully paid-up rights: to publish the entrants’ details and contributions in connection with this competition.
- All photographs taken will remain the property of Eskom and finalists have the option to agree that Eskom and all its subsidiaries may use the photographs for publicity purposes.
- Entrants have the option to grant Eskom and its subsidiaries the right, except where prohibited by law, to use the entrant’s details for competition purposes in promoting or publicising the competition, including the right to name the winner(s) of the prize(s) in public.
- All entrants indemnify Eskom, its advertising, media and PR agencies, advisers, suppliers, nominated agents, and consultants against any and all claims, damages or loss howsoever arising, including but not limited to wilful misconduct or negligent act or omission arising from their participation in this competition.
- Eskom reserves the right to cancel or alter any aspect of the competition at any time at its sole discretion without liability
- Entrants and finalists agree that contravention of one or more of these terms and conditions will disqualify them from further participation in the competition.
- Any breach of the terms and conditions may, at Eskom’s absolute discretion, result in forfeiture of any prize.
- The judges’ decision is final, and no correspondence will be entered into. The competition is audited.
- These terms and conditions are subject to change according to Eskom’s discretion.
- You may change or edit the application at any time as long as it is before the closing date
- The competition’s closing date is 17th October 2021, and no late entries will be accepted
